Terms of Service

1. Acceptance of Terms

By accessing or using Libraryly ("the Service"), operated by Prince Edit House ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

These terms apply to all users of the Service, including library owners, administrators, staff members, and students who access the platform through the student app.

2. Service Description

Libraryly is a cloud-based library management SaaS (Software as a Service) platform designed for private study halls, reading rooms, and coaching center libraries in India. The Service includes:

• Web Dashboard: Library management interface for owners and administrators
• Owner Mobile App: Android application for on-the-go library management
• Student Mobile App: Android/iOS application for student engagement
• Study Buddy AI: AI-powered study tutor for enrolled students
• WhatsApp Billing: Fee reminder integration via WhatsApp
• QR Attendance: QR code-based check-in/check-out system

3. User Accounts

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring that students added to your library have consented to their data being stored

You must be at least 18 years old to create a library owner account. Student accounts may be created for users of any age with guardian consent where applicable.

4. Payment Terms

Libraryly offers multiple subscription plans including a free tier. For paid plans:

• Billing Cycle: Subscriptions are billed monthly. Prices are in Indian Rupees (INR).
• Payment Methods: We accept UPI, debit cards, credit cards, and net banking through our payment gateway.
• Auto-Renewal: Paid subscriptions auto-renew at the end of each billing cycle unless cancelled.
• Price Changes: We reserve the right to modify pricing with 30 days advance notice to existing subscribers.
• Taxes: All prices are inclusive of applicable GST unless stated otherwise.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to other users' data or library records
• Use automated scripts, bots, or crawlers to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with unauthorized third parties
• Use the Service for any purpose other than legitimate library management

6. Data Privacy

Your privacy is important to us. Our data handling practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key data protection measures include:

• Row Level Security (RLS): PostgreSQL RLS ensures complete tenant data isolation
• Encryption: All data is encrypted in transit (HTTPS/TLS) and at rest
• No Data Selling: We never sell, rent, or share your data with third-party advertisers
• Data Portability: You can export your library data at any time via the dashboard

7. Intellectual Property

The Service, including its design, code, features, branding, and documentation, is owned by Prince Edit House and protected by intellectual property laws. You may not:

• Copy, modify, or distribute any part of the Service
• Use the Libraryly brand, logo, or name without written permission
• Create derivative works based on the Service

You retain ownership of all data you input into the Service (student records, financial data, etc.). We claim no intellectual property rights over your content.

8. Service Availability & Limitations

We strive for 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (announced 24 hours in advance)
• Emergency security patches
• Force majeure events beyond our control
• Third-party service provider outages

9. Limitation of Liability

To the maximum extent permitted by Indian law, Prince Edit House shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of revenue or business opportunities
• Data loss due to circumstances beyond our control
• Damages arising from unauthorized access to your account
• Issues caused by third-party integrations or payment gateways

Our total liability for any claims arising from the Service shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate the agreement:

• By You: Cancel your subscription at any time from the dashboard. Your data will be retained for 30 days after cancellation.
• By Us: We may suspend or terminate accounts that violate these Terms, with notice where practicable.
• Data After Termination: You may request a data export within 30 days of termination. After 30 days, your data will be permanently deleted.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via:

• Email notification to registered library owners
• In-app notification on the dashboard
• Updated date at the top of this page

Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Rajasthan, India.
